These Terms of Service govern access to and use of AFINCE, including any website, mobile app, support channel, or related service that links to these Terms.
1. Acceptance
By accessing or using AFINCE, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.
2. Service Description
AFINCE provides read-only personal finance insights, including transaction visibility, account balance visibility, budgeting summaries, spending categories, and recurring expense insights. Financial account connections are provided through Plaid or similar third-party providers authorized by the user.
3. No Financial, Legal, Tax, or Credit Advice
AFINCE provides informational tools only. AFINCE does not provide financial advice, investment advice, legal advice, tax advice, credit repair, lending, banking, brokerage, money transmission, or payment initiation. Users remain responsible for financial decisions, account reviews, tax filings, payments, transfers, and obligations.
4. Eligibility and Accounts
Users must be legally able to enter into these Terms and must provide accurate account information. Users are responsible for safeguarding login credentials, devices, and any account recovery methods. Notify us promptly at support@afince.com if you suspect unauthorized access.
5. User Responsibilities
- Use AFINCE only for lawful, personal, and authorized purposes.
- Connect only accounts you own or are authorized to access.
- Review original bank, card, and financial institution records before relying on displayed data.
- Do not attempt to bypass security, scrape, reverse engineer, overload, resell, or misuse the service.
- Do not upload or transmit malware, unlawful content, or information that infringes third-party rights.
6. Third-Party Services
AFINCE relies on third-party providers, including financial data providers such as Plaid and cloud infrastructure providers. Third-party services may have their own terms and privacy policies. AFINCE is not responsible for outages, errors, data limitations, or actions of third-party financial institutions or data providers.
7. Data Accuracy and Availability
Financial data may be delayed, incomplete, duplicated, categorized incorrectly, unavailable, or changed by financial institutions and data providers. AFINCE does not guarantee that balances, transactions, categories, or recurring expense predictions are accurate or current. Users should verify important information with the original financial institution.
8. Privacy and Security
Use of personal and financial information is described in the Privacy Policy. Security practices are summarized in the Security Center. No system can be guaranteed 100% secure, but AFINCE uses reasonable controls designed to protect sensitive data.
9. Account Suspension and Termination
We may suspend or terminate access if we reasonably believe a user violated these Terms, created security or fraud risk, misused the service, or if continued access would expose AFINCE, users, or partners to legal or operational risk. Users may stop using AFINCE and request deletion at any time by contacting support.
10. Changes to the Service
AFINCE may update, modify, pause, discontinue, or limit features at any time. We may provide notice of material changes when practical, but some changes may occur without advance notice for security, legal, operational, or provider-related reasons.
11. Intellectual Property
AFINCE, the AFINCE name, website content, app content, designs, software, and related materials are owned by AFINCE or its licensors. These Terms do not transfer ownership. Users receive a limited, revocable, non-exclusive, non-transferable right to use the service for its intended purpose.
12. Disclaimers
AFINCE is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, AFINCE disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and uninterrupted operation.
13. Limitation of Liability
To the fullest extent permitted by law, AFINCE and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, financial decisions, missed payments, overdrafts, fees, or reliance on displayed information. AFINCE's total liability for claims relating to the service will not exceed the greater of the amount paid by the user to AFINCE in the three months before the claim or USD $100.
14. Indemnification
Users agree to defend and hold AFINCE harmless from claims, losses, liabilities, damages, costs, and expenses arising from misuse of the service, violation of these Terms, unauthorized account connections, or violation of law or third-party rights.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, unless applicable law requires otherwise. Before filing a claim, users agree to contact support@afince.com and attempt to resolve the issue informally for at least 30 days.
16. Updates to Terms
We may update these Terms from time to time. The "Last Updated" date shows when the latest version became effective. Continued use after updates means acceptance of the updated Terms.
